BLACKMAIL - A criminal act of extortion, malicious threatening to do injury to another to compel him to do an act against his will. Usually involves the threat to release information, often true, about the person that will defame his reputation or bring criminal actions against him.
The criminality lies not in the release of the information - at least if true - but in the extortionate aspects of the threat to do so.

Mr. Steven Schenck sent Paco an email for posting (http://ccpoa.blogspot.com/2004/09/as-promised.html) asserting CCPOA, Paco and essentially everyone in the Agency who isn't supportive of Rod Hickman are racists. It was posted as promised.
TODAY, Paco received another email from Mr. Schenck (now "Reverend Schenck) which he sent to my personal email box. (It's not hard to track email aliases but since there are plenty of people who know my "real" name, including some high-level managers, I never thought anyone would bother.) So, now that Reverend Sherlock has unlocked this open secret, he posits he has Paco by the shorthairs and sends this:

Reverend Schenck must really be highly connected because documented blackmail, with intent to deny or restrict another's civil rights over the public internet amounts to a handfull of VERY SERIOUS FELONIES. Not only will Paco be contacting the US Attorneys Office on Monday, I will also be contacting the IG and AG, via my State Senator and Assembly Member, to demand investigations into whether the crimes he has committed were done so at Mr. Hickman's behest.
I'm guessing you are NOT a CPO, Rev. If you are, you are a crappy one. You see, the first rule of survival inside is to know your limitations (variations: know who you are dealing with, don't bite off more than you can chew ...). Given the preceding, YOU gave me YOUR name, address and phone number. Comparatively, you know my name. Hmmmm. Who has the upper hand here?
Don't worry, Rev. You don't have to worry about knuckle-draggers cruising your shack. The only further use I have for your address is to have the subpoenas sent there.

As the Reverend Mr. Schenck would know if he had any meaningful experience in dealing with CPOs, we do not respond well to threats. We can sometimes be persuaded, we can usually be directed (by our bosses, within the legitimate scope of their authority and our job), we can seldom be bullied. Speaking as one who has had dealings with people like this, I will be happy to donate to the Paco Villa Legal Defense and Action Fund. Let me know where to send the check.

Assuming the First Amendment didn't exist and there was no constitutionally protected right to administer this most excellent blog, Spud and his step-and-fetch-it minions would still have to make a case for racism other than "you're a racist Paco because you say mean things about a Black man." That's the distilled essence of the arguments put forward by the form letter crowd and the "Reverend" Schenck.
We detest Spud not because he is an African American. We detest him because his first action as YACA secretary was to codify a "code of silence" that never existed other than at the top levels of CDC management in which Hickman thrived. We detest Spud because he apologized for the P&CSD's parole revocation rates when he should have been defending them as a very cost effective way to protect the public. Spud then proudly implemented a "parole model" that keeps dangerous, drug crazed felons out in our communities.
What I have just listed are four facts that support Paco's position of contempt for Spud. It is a position shared by most CPOs and this old, over promoted guard.
Playing the race card often works. Timid managers are often intimidated in this manner. It doesn't work with CPOs who understand the difference between right and wrong. It doesn't work with CPOs who understand that constitutional rights apply to us as well as Spud's beloved felons and it won't work with Paco who has taken better shots from better men over the years.

At 0930 hours, a complaint alleging conspiracy to deprive Paco of his civil rights was filed with the FBI's Sacramento Office. A complaint was later lodged with the Office of Inspector General, requesting an investigation to determine what connection, if any, Roderick Q. Hickman has to this conspiracy. The IG has requested a written complaint, which is being sent via certified mail TODAY.

Good luck with the Inspector General Paco. My experience with that agency was just as frustrating as dealing with the Office of Internal Affairs. My guess is that you will recieve the following standard "Brush Off" letter that will read something like the following, "Our office has received your complaint where you allege an associate of Roderick Hickman may have committed blackmail. We have reviewed you compliant and have determined there does not exist sufficient evidence to warrant an investigation by this office."
What disturbs me is that the IG will not, at minimum, conduct a preliminary investigation to determine the merits of you allegations. Please publish the response from the IG. You could have evidence that would jump up and slap the IG in the face and he still would not investigate! Also, ask the IG if you put on a blue shirt will he then investigate?

It's appallingly obvious that Hickman created the 'Code of Silence' to give the impression that he is the right person to erase the problem. Now we have a case where, if there is a code, Hickman will stand up and expose his relationship to Shenck and what his role he played in the extortion and conspiracy to violate Paco's First Amendment rights.
Paco, please contact Speier and Romero. Since those two are so concerned with the problems within the Department of Corrections I'm sure they'd jump on this obvious abuse of authority from the top office of the department. If they do not then it is proof of their complicity in the 'Code of Silence'.

Paco, I wish you the best with both the OIG and FBI. OSAPian's experience with the OIG has been unsatisfactory for the most part. Those who follow such matters know the OIG recently suffered a major reduction in force. The office wasn't very strong to begin with (see Paco's excellent posit of 5-27-04). Many former deputy IGs have returned to the CDC mothership in various capacities. Some are working as ISU gumshoes for the wardens they once investigated/audited. This does give those of us who gave the OIG information before Spud told us a Code-of-Silence existed pause wonder what these former IGs have shared with CDC's management team. Everything, I venture to guess.
The FBI is an organization with which I have had no dealings in my long, if not stellar, career although I was a big Efrem Zimbalist Jr. fan as a younster. I do know more than several badge brothers at Corcoran who had extensive, very unpleasant contacts with FBI agents. It will be interesting to see if today's FBI pursues those who are violating Paco's civil rights with the same zeal they exhibited going after the infamous--and not guilty--"Corcoran seven."

I believe the african american cpo community as a whole has assembled to defend him any way they can. They did it with OJ, they also did it with Kobe and MJ. I witnessed for myself first hand at an african american function with Rod as the guest speaker how this man is the savior to his people. How this man will now right the wrongs that his peole have endured over the years. I was almost sick to my stomach listening to this man speak. All I heard was it's time to clean this department up, we will get rid of the dirty officers and there will be no more beating of inmates or code of silence. I sat there puzzled as I watched african american cpo's clap and cheer for this man after what he had just said. Was he not talking about them too? I guess the only dirty officers that are beating up inmates and fostering the code of silence are everything but african american.
